Article 1 In order to regulate the management of special funds for the development of state-owned metallurgical and mining enterprises, improve the use efficiency of financial funds, and promote the development and utilization of domestic iron ore resources, these Measures are formulated in accordance with the relevant provisions of the national steel industry policy and financial budget management.
Article 2 The special funds for the development of state-owned metallurgical mining enterprises refer to the central financial budget, which is mainly used to support state-owned medium-sized metallurgical mining enterprises to increase or stabilize domestic iron ore production, improve iron ore grade and beneficiation recovery rate, and carry out mine environmental transformation and other special funds.
Article 3 The term "mining enterprises" as mentioned in these Measures refers to local state-owned medium-sized enterprises with independent legal person status and mainly engaged in iron ore mining and dressing business, including wholly state-owned companies and state-owned absolute holding companies. For the time being, it does not include relatively state-owned holding and shareholding companies, as well as metallurgical mining enterprises invested and established by central enterprises.
Article 4 The classification of mining enterprises shall refer to the relevant standards determined in the "Notice on Adjusting the Production and Construction Scale Standards of Some Mineral Mines".
Article 5 The use and arrangement of special funds shall adhere to the following principles: comply with the requirements of national macroeconomic policies and iron and steel industry policies; make scientific arrangements, stress practical results, and give full play to the guiding role of financial funds; be open, fair, and just, and actively accept social supervision , to ensure the safety of financial funds.
Article 6 The support content of special funds includes mine construction projects. Support mining enterprises to build new mines or implement reconstruction and expansion projects on existing mines in order to increase or stabilize iron ore production. Support mining enterprises to implement new mining and beneficiation technologies, new process development and application projects in order to improve the grade of iron ore, improve the recovery rate of beneficiation and save resources and energy. The above supported projects include new projects in the current year and continued projects invested in previous years but not yet completed.
Article 7 In principle, special funds shall be invested in the form of capital funds.
Article 8 For mining construction projects, the amount of capital investment generally does not exceed 20% of the planned investment in the current year of the project; for the development and application projects of new technologies and new technologies for mining and selection and environmental improvement projects, the amount of capital investment generally does not exceed the current year of the project. 30% of the planned investment.
Article 9 For projects that have obtained the support of central financial funds through other channels, the special funds will not be repeatedly supported.
Article 10 Mining enterprises shall, before March 31 each year, apply for special funds to the financial department at the same level according to their affiliation. Article 11 The financial departments of all autonomous regions, municipalities directly under the Central Government, and cities under separate state planning shall be responsible for the project application work of enterprises in their respective regions, and conduct a preliminary examination of the authenticity, completeness and feasibility of the application materials. And before April 30 every year, the application documents and preliminary examination opinions of the special funds in the region shall be submitted to the Ministry of Finance.
Article 12 The Ministry of Finance shall formulate a project support plan according to the preliminary examination opinions of local financial departments and the annual budget arrangement of special funds.
Article 13 Before June 30 each year, the Ministry of Finance shall publicize the project support plan to the public through the Ministry of Finance website. The announcement time is not less than 7 working days. When the publicity period expires, the Ministry of Finance shall perform the special fund allocation procedure.
Article 14 After the mining enterprise receives the special funds, it shall conduct financial processing in accordance with the relevant provisions of Article 20 of the General Financial Rules for Enterprises.
Article 15 Financial departments at all levels shall strengthen the supervision and management of special funds, and conduct annual performance evaluations on the use of special funds. The evaluation contents mainly include: whether the special funds are used in accordance with the application projects and the specified purposes; whether the financial treatment of the special funds by the enterprise is standardized; whether the actual progress of the project is consistent with the planned progress, and whether there is a significant difference between the actual investment and the planned investment; whether the project is realized Expected goals, whether the use of special funds has indeed played a guiding and driving role, etc.
Article 16 The provincial finance department shall submit the performance evaluation report of the special fund of the previous year to the Ministry of Finance before April 30 each year.
Article 17 The performance evaluation report is an important basis for the Ministry of Finance to arrange special funds for this year. If the funds were not used according to the prescribed purposes in the previous year, and the project implementation situation was seriously out of line with the application plan, the Ministry of Finance will withdraw all or part of the special funds.
Article 18 Units or individuals who defrauded, detained, embezzled, or misappropriated special funds in violation of the provisions of these Measures shall be dealt with in accordance with the "Regulations on the Punishment and Punishment of Fiscal Illegal Acts".
Article 19 These Measures shall be interpreted by the Ministry of Finance.
Article 20 These Measures shall come into force as of the date of issuance. The Administrative Measures for Special Support Funds for Metallurgical Independent Mines promulgated by the Ministry of Finance in 2001 shall be repealed at the same time.
